What is the 4-year conservatory rule and how does it work?
The four-year rule meant an unauthorised building became immune from planning enforcement after four years. In England this is now 10 years for work substantially completed on or after 25 April 2024. Older work still follows the four-year limit, so the completion date decides which applies.
How does the rule work?
The clock starts when the building is substantially complete. If the council takes no enforcement action within the time limit, the building is generally immune, and a certificate of lawful development can confirm this in writing.
Does it apply to every conservatory?
No. A conservatory that meets permitted development limits needs no planning permission, so the rule only matters when it breached those limits. The 10-year change applies to England only, so Wales and Scotland should be checked separately.
Does it cover Building Regulations?
No. Building Regulations enforcement follows separate rules, so a conservatory can be immune from planning action and still lack required approval. Solicitors usually ask for both when a property is sold.
